Why have laws? WHy have rules? People will always come up with a reason why their's is a different situation. It's their up-bringing, or it's their religion, or my personal favorite it's their mother.
Backing off a problem because it creates a conundrum forces chaos and instability because then laws cannot possibly be created, because someone MAY at some time somewhere get caught and is innocent.
