I believe, differentiates between the rights of the States---as versus the rights of the individuals. That was the basic arguement about the Bill of RIghts and why the Constitution wasn't unanimously signed--the original articles with a very few exceptions were about the functioning of the government and interrealations with states and other branches--to include assigning of specific responsibility--the Bill of Rights was much more focused on individual rights that everyone should have, regardless of state or federal desire
